Terms of Service

Jovial is a product of Courselytics LLC. These terms are an agreement between you and Courselytics LLC (“we”, “us”).
Who can use Jovial
These terms cover three groups. Course customers use Jovial as businesses. Golfers use the app to call a cart. Cart staff use it while they work a course's cart.

The service
A golfer taps a button to call the beverage cart already on that course. The cart comes to them. The app is not self-ordering. There is no menu, no chat, and no checkout. The course sells the drinks and food. Courselytics LLC is not the seller.
The course's account
The course is responsible for:
- The people it invites as cart staff and admins.
- Keeping its account information accurate.
- How its staff use Jovial on a shift.
Staff and admins sign in with an email link. There are no passwords. Admins can revoke staff sessions.
Alcohol and age checks
If the course sells alcohol, selling it lawfully is the course's job. That includes checking age. Courselytics LLC does not sell alcohol and does not check age.
Golfers
A tap asks the cart to come. It is not a promise that the cart will arrive, or arrive by a certain time. Timing depends on the course and the cart. Courselytics LLC is not the seller of the food or drink, and a request is not an order.
Subscription, trials, and payment
Courses pay a flat subscription through Stripe. A card is saved at signup. We do not store the full card number. Stripe does.
If Courselytics LLC grants a trial, the first charge waits until the trial ends. The saved card is then charged automatically. A trial is something we grant. It is not included with every signup.
We may add taxes the law requires. The course is responsible for those taxes, other than taxes on our own income.
A course can cancel by emailing hello@getjovial.com. Cancellation takes effect at the end of the current billing period, unless we say otherwise. Fees already due stay due.
Acceptable use
Don't:
- Break the law, including laws on the sale of alcohol.
- Interfere with the service, or try to reach another course's data.
- Pretend that Courselytics LLC is the seller of the food or drink.
- Misuse staff or golfer location.
Location
The golfer app uses the phone's location only while a request is open, and only if the golfer allows it on the device. We stop when the request closes.
Cart staff location is used only while that person is live on a shift, and only inside their course's geofence. We use it to route the cart and to compute ETAs and pace of play.
Phone location can be wrong. Courselytics LLC is not an emergency service.
Intellectual property
We and our licensors own the service, the apps, this website, and the Jovial name and logo. We give you a limited right to use them while these terms apply. That right is not a transfer of ownership. The course keeps its own data.
Customer data
How we handle personal data is described in the Privacy Policy. Where the course decides why and how its staff data is used, the course is the controller and Courselytics LLC is the processor. A data processing agreement is available on request.
Other services and map data
Parts of Jovial run on other companies' services, including Supabase, Vercel, Stripe, Google Workspace, Expo, Apple, and Google. Apple and Google also deliver push notifications and host the app stores. Resend is planned for transactional email. Their terms apply to what they provide.
Course directory and map data comes from OpenStreetMap (© OpenStreetMap contributors, ODbL), Overture Maps, GeoNames, and the US Census. Those sources have their own terms.
Disclaimers
The service is provided as available. We do not guarantee that a cart will reach a group, that an ETA will be exact, or that the service will be uninterrupted. To the extent the law allows, we disclaim implied warranties, including merchantability and fitness for a particular purpose.
Limits on liability
To the extent the law allows, Courselytics LLC is not liable for indirect or consequential losses, lost profits, or for the course's own sales of food and drink. A missed stop is not a sale by Courselytics LLC.
Our total liability to a course in a 12 month period is limited to the fees that course paid us in those 12 months. The golfer app is free. We are not liable to a golfer for a cart that does not arrive.
These limits do not apply where the law does not allow them, including liability that cannot legally be limited.
The course covers certain claims
The course will cover claims, losses, and reasonable legal costs brought against Courselytics LLC that arise from the course's sale of food or drink, its staff, the information it gives us, or its failure to follow the law, including age checks for alcohol. This does not apply to the extent the claim is caused by our own breach of these terms.
Suspension and ending access
We may suspend or end access if a course does not pay, or if anyone using the account breaks these terms. A course may stop using Jovial at any time. Cancellation of a paid plan follows the billing section above. When access ends, we handle personal data as the Privacy Policy describes.
Changes
We may update these terms. The date at the top will change. If a change materially affects a paying course, we will email that account before the change applies.
Which law applies
These terms do not choose a state. For a paying course, the governing law and the place where disputes are heard are the ones stated in that course's order form or agreement.
